On Wednesday 28-Feb-2018 in room 321 at 3:00 Pm , Dr. Abdubasit Kareem Mawlood presented workshop on“implementation of foreign judgments in Iraq”. The Law on the Regulation of Foreign Judgments No. 30 of 1928 regulates the provisions relating to the implementation of foreign judicial declarations.
Under these provisions,the provisions of foreign courts in Iraq can only be implemented after the right holder obtains a decision to implement them in an Iraqi court. The following conditions must be met in each provision, Iraq.
1. Informing the other party of the case brought before the foreign court.
2. The case shall be considered by a competent court.
3. The judgment relates to debt or amount of money.
4 -The ruling should not be contrary to public order and literature.
5. The judgment shall be enforceable in his country.
All that has been said are the conditions of formality and the foreign court remains competent to the deep details of the case.
